1. Glossary

Processing agents: The controller and the operator responsible for processing personal data, under the LGPD.

Controller: Natural or legal person, of public or private law, who makes decisions regarding the processing of personal data.

Operator: Natural or legal person, of public or private law, who processes personal data on behalf of the controller.

ANPD: National Data Protection Authority - Public administration body responsible for overseeing, implementing, and enforcing the LGPD.

Anonymization: Utilization of reasonable and available technical means at the time of processing, by which data loses the possibility of direct or indirect association with an individual.

Consent: Free, informed, and unequivocal manifestation by which the data subject agrees to the processing of their personal data for a determined purpose.

Personal data: Information related to an identified or identifiable natural person.

Sensitive personal data: Personal data regarding racial or ethnic origin, religious conviction, political opinion, union affiliation or organization of a religious, philosophical, or political nature, data referring to health or sexual life, genetic or biometric data.

2. Relevance and Objective

This Privacy Policy is part of the Data Governance Program of AINEXT Tecnologia LTDA. – EPP, owner of the MYRMEX platform. Its objective is to ensure transparency regarding the processing of personal data in the hiring and use of our services, throughout the entire information lifecycle.

3. Commitment

AINEXT values privacy and treats personal data collected in the use of the site and the Platform as confidential. Data is processed in infrastructure that observes high international security standards, complying with market best practices, guided by Laws such as LGPD, GDPR, and international standards like ISO 27.001.

4. Justification for Data Processing

AINEXT collects and processes personal data of its Contractors and Users with the aim of enabling the provision of contracted services and ensuring the proper functioning of the Platform, strictly observing the principles and legal bases provided in the LGPD.

5. Use of Artificial Intelligence

The MYRMEX Platform uses artificial intelligence and machine learning technologies to continuously improve its functionalities. Data and messages entered by Users in the chat may be used, in an anonymized and aggregated form, for performance analysis, algorithm improvement, and AI model training.

Recommendation to Users:

Avoid entering sensitive personal data (information about racial origin, health, sexual orientation, religious or political beliefs) during chat use, as all content may be made available to the Contractor (company) for monitoring or efficiency evaluation purposes.

6. Sharing and International Data Transfer

AINEXT performs international transfer of personal data necessary for the execution of MYRMEX Platform services, especially due to the use of the Google Cloud Platform storage provider (United States). All transfers observe the LGPD and Resolution CD/ANPD No. 19/2024, ensuring a level of protection equivalent to that provided in Brazilian legislation.

7. Data Retention and Elimination

AINEXT keeps personal data only for the time necessary to fulfill the specific purposes that justified their collection. Registration data is kept during the contractual relationship and for up to 5 years after its termination. Access logs are kept for 6 months. After the period expires, data is securely eliminated or anonymized.

8. Security Controls

AINEXT employs technical and physical measures to prevent improper processing of personal data. All data transfer on the Platform is performed via secure protocol. There are firewalls, antivirus, and vulnerability detection systems on all servers. In the event of security incidents with relevant risk, AINEXT commits to informing the ANPD and affected data subjects.

9. Exercise of Data Subject Rights

At any time, the User or Data Subject may request, via the channel privacy@ainext.com.br:

  • Confirmation and access: Verify if AINEXT processes personal data and, if so, request a copy.
  • Correction: Request correction of incomplete, inaccurate, or outdated personal data.
  • Anonymization, blocking or elimination: Request anonymization, temporary blocking, or elimination of data (except for legal retention hypotheses).
  • Portability: Request that AINEXT provide your personal data in a structured and interoperable format.
  • Information about sharing: Obtain information about entities with which AINEXT shares data.
  • Information about the possibility of not consenting: Receive clear information about the possibility and consequences of not providing consent.
  • Revocation of consent: Withdraw consent at any time, through a free and facilitated procedure.
